Terms and Conditions of the Monatine.pl Online Store

Terms of Service The online store https://monatine.pl protects consumer rights. Consumers cannot waive rights granted to them by the Consumer Rights Act. Contract provisions less favorable to the consumer than the provisions of the Consumer Rights Act are invalid, and the provisions of that Act shall apply in their place. Therefore, the provisions of these Regulations are not intended to exclude or limit any consumer rights resulting from mandatory legal provisions, and any doubts should be clarified in favor of the consumer. In case of any inconsistency between the provisions of these Regulations and the above-mentioned provisions, the latter shall prevail and be applied.

II. Technical Requirements
To use the Store, you need a device with internet access, a current web browser, and an active email account. The Seller uses technical measures to ensure data security, including SSL encryption.

III. Terms of Use of the Store
The Customer is obliged to use the Store in accordance with applicable law and good practices. It is forbidden to provide unlawful content and to interfere with the operation of the Store. The prices of Goods provided in the Store are gross prices and include VAT, but do not include delivery costs, which are indicated separately when placing an order. In the event of a price reduction announcement for a Good, the Seller informs about the lowest price of that Good applicable within 30 days before the reduction was introduced.

IV. Sales Agreement
Placing an order by the Customer constitutes an offer to conclude a sales agreement. The agreement is concluded upon confirmation of the order by the Seller. The Seller may refuse to fulfill an order in justified cases, in particular in case of incorrect data, lack of payment, or an obvious pricing error.

V. Payments
Available payment methods include cash on delivery, electronic payment via Stripe, and electronic payment via Przelewy24. In the case of electronic payments, the Customer is obliged to make the payment immediately after placing the order.

VI. Delivery of Goods
Delivery of Goods is carried out in the territory of ____________________. The order fulfillment time is from ___ to ___ business days, unless otherwise specified in the Goods description. Delivery costs are provided when placing an order. In the case of a Consumer, the risk of loss or damage to the Goods passes to them upon receipt of the shipment, while in the case of an Entrepreneur, this risk passes at the moment the Goods are handed over to the carrier.

VII. Right of Withdrawal from the Contract
A Consumer and an Entrepreneur with consumer rights have the right to withdraw from the contract within 14 days without giving any reason. This period starts from the day of receiving the Goods. In case of withdrawal from the contract, the Seller shall refund all received payments within 14 days, using the same payment method used by the Customer, unless the Customer agrees to a different solution. The Buyer bears the direct cost of returning the Goods. The Buyer is responsible for the decrease in the value of the Goods resulting from using them in a manner exceeding what is necessary to ascertain their nature, characteristics, and functioning. The right of withdrawal from the contract does not apply to sealed products whose packaging has been opened after delivery, if they are not suitable for return due to hygiene reasons, this particularly applies to underwear.

VIII. Complaints about Goods
Goods offered in the Store must be compliant with the contract. The Seller is liable for non-conformity of the Goods with the contract for a period of 2 years from the date of delivery. In case of non-conformity, the Customer has the right to submit a complaint and demand repair, replacement, price reduction, or withdrawal from the contract. The complaint should contain the Customer's data, order number, and a description of the problem. The Seller will consider the complaint within 14 days of its receipt. If the complaint is accepted, the Seller bears the costs of bringing the Goods into conformity with the contract.

IX. Out-of-court dispute resolution
The consumer has the option to use out-of-court methods of complaint handling and claims pursuit, including through the ODR platform for online dispute resolution.

X. Personal Data

XI. Amendments to the Regulations
The Seller reserves the right to amend the Regulations in the event of changes in legal provisions or the development of the Store's functionalities. Users will be informed about the changes in an appropriate manner, in particular by publishing information on the Store's website or sending an e-mail.

XII. Final Provisions
The Regulations do not exclude or limit any consumer rights resulting from applicable law. The Customer has the opportunity to review the Regulations at any time, download, save, and print them. The Regulations are effective from __________.
